Delhi HC Orders Takedown of Fake Experion Website Using Its Trademarks

The Delhi High Court on 16 October 2026 restrained the operator of a website that used Experion Developers' EXPERION trademarks and the name of its upcoming Emerelle Reserve project, and directed the domain registrar to block it. The order is an interim injunction, and it concerns the website, not the project's approvals.

What the court ordered

On 16 October 2026, the Delhi High Court allowed Experion Developers Pvt. Ltd.’s application for an ad-interim injunction. The order is interim, meaning it applies until the next hearing date.

The website operator, and anyone acting for them, is restrained from using the ‘EXPERION’ word mark or logos, including ‘EXPERION EMERELLE RESERVE’, or any identical or deceptively similar mark. The restraint covers use online or offline, as a trademark or as a domain name.

The domain registrar, Endurance International Group India Private Limited, was directed to remove, disable and block the website within 72 hours of receiving notice. The suit was filed against Ishu Singh, the apparent registrant of the site, and the registrar.

The court’s reasoning

According to the court report, the use of the EXPERION mark and the project name on the website was prima facie dishonest. The court described it as an attempt to ride on Experion’s goodwill and reputation, which would cause confusion in the market.

The court noted that Experion is the registered proprietor of its trademarks and has used the marks continuously since 2011.

Experion told the court that it had only recently applied for RERA registration for the project and had not advertised it or published its details on its website or elsewhere. It said the disputed website nonetheless displayed project information, prominently used the EXPERION mark, and presented itself as an authorised channel partner. Experion said it had not authorised the operator in that role.

The project and its approval status

The project named in the dispute is Experion Emerelle Reserve, a residential project planned for Sector 88A near the Dwarka Expressway in Gurugram. As of 23 October 2026, the court order does not decide any question about the project’s approvals.

A Haryana RERA public notice lists an application for registration of Experion Emerelle Reserve in Sector-88A, Gurugram, developed by Experion Developers Pvt Ltd. The application is listed as pending.

Listings on third-party sites give differing details. They describe 3, 3.5 and 4 BHK apartments of 2,100 to 3,200 sq ft, and give land areas of 6.81, 7 and 7.8 acres. Starting prices vary by site. The developer’s own site lists ₹3.87 Cr onwards. The planned possession date of August 2031 appears in one listing. These figures are not yet confirmed against RERA records.

Context on the developer

Experion Developers Pvt Ltd is registered at 8th Floor, Wing B, Milestone Experion Centre, Sector-15, Part-2, Gurugram. Its managing director, per the Haryana RERA form, is Nagaraju Routhu. The company says it has been in real estate development since 2006.

Two other matters involving the developer are on record. The Delhi High Court declined interim relief to Experion Developers in a Delhi Police Economic Offences Wing FIR (No. 64/2026), which concerns alleged manipulation of the Dignity Buildcon insolvency process. A complaint by Clarion Properties Ltd (RERA-GRG-1849-2022) against Experion is pending before Haryana RERA. These matters are separate from the trademark order.

What it means for buyers

The order protects Experion’s name and project name from use by a third party. It does not confirm or reject the project’s RERA registration.

The developer’s own site advises users to verify project approvals, sizes and RERA registration status on the official Haryana RERA website.

What comes next

The injunction stays in force until the next hearing. The suit is listed before the Joint Registrar on 22 December 2026 for completion of service and pleadings, and before the court on 3 February 2027.

The registrar’s 72-hour deadline runs from receipt of the notice. The Haryana RERA application for Emerelle Reserve remains pending.
